The cancellation button requirement applies to all retailers that conclude
B2C distance contracts with consumers through digital channels such as:
- online shops
- apps
- digital marketplaces, or
- social media platforms
This includes, among other things, online purchases, downloads, and digital services.
In the case of sales through marketplaces such as Amazon or eBay, as well as through social media platforms such as Instagram or TikTok, the retailer generally remains responsible for complying with the requirements. At the same time, practical implementation depends on the platforms providing or allowing appropriate technical functionality.
B2B contracts are generally exempt from the requirement.
In addition, the well-known exceptions to the right of withdrawal – for example, for certain digital content such as tickets, perishable goods, or customized services – continue to apply regardless of the cancellation function.
